It's an interesting case.  Wordpress has taken the hardline position 
that all themes (at least, the php code portion thereof) must be gpl, 
but the case of Thesis as the real target is not quite so controversial. 
  Thesis copied code from Wordpress to put into their theme, then turned 
it into a commercial proprietary app.  In essense, they tried to 
steamroll over the GPL, and Wordpress took them to task for it, as they 
should.
