It's probably worthwhile to read the original article by Bradley Kuhn
of the Software Freedom Conservancy:

I understood from this that if ZFS was bundled as source code,
requiring compilation by the end-user, then the distribution would be
compatible with GPL. The problem comes from having it included as a
binary kernel module.

Oracle doesn't understand Free Software. It's unlikely we'll see a
resolution to this, unless someone creates a new, compatible file
system without using any of the CDDL licensed source code.
